Did The Bafoons Give UPS 60 Days Notice?

The people that are negotiating our contract need to give the company 60 days notice to justify a strike. Did they do this? Or is this just another shit show just like 2013? Right now it is too late.

    Collective bargaining (Section 8(d) & 8(b)(3))
    • Terminate or modify a collective-bargaining agreement without serving written notice on the employer at least 60 days (90 days if collective bargaining involves employees of a healthcare institution) before the expiration date of the contract.

Plus, the National Labor Relations Act politely asks that workers notify their employers 60 days before going on strike. Without that 60-day advanced notice, workers won’t receive legal protections under the NLRA and may be fired or disciplined for going on strike — unless they’re striking over unfair labor practices.

A union must bargain in good faith on behalf of employees it represents, and it is unlawful for a union to fail to do so. Examples of failing to do so include insisting to impasse on a nonmandatory subject of bargaining, or reaching a collective-bargaining agreement with an employer but then refusing to sign it.

WTF. You got to be kidding me. This is crazy. UPS will take full advantage of it and go after activists. Thank you for sharing. I had no idea.

Thanks for your research on this. Similar to 2013 except the biggest critic is now the perpatrator.

We've been through this before. Who were the "lead negotiators"? Ken Hall & Sean O'brien.

Since David Allen from Roswell Hub said that Kurwood was a "long time activist", we should ask him why the last minute strike authorization vote? Where's the notice to strike since all these assholes are giving out STRIKE pamphlets, including my local.

All these O'brien supporters who were in the Vote No Movement should be ashamed of themselves.

Notice should be given 60 days prior to the expiration.

Frankly, this is a required step in the process. If they didn't terminate the agreement or open it in a timely fashion UPS could refuse to negotiate. So, it is a requirement, not oz being tough. Although, most of what the members are getting has the makings of a bad Broadway comedy, mostly theatrics and not much truth. Their local leaders are either counting their monthly stipends, or worried that if they speak up, the weaponized tdu/ IIO will show up at their door, so they either are too scared, bought off by ibt stipends, or oblivious to the bs. The members deserve the truth and they deserve better than this second rate fabrication.

Sean screwed up. He pumped up the Members with the strike talk. The tentative agreement will be average at best and the Members are going to be livid. There will not be a part timer pay raise to 25 dollars. So what happens now that the International can't push the contract through? We are in for a clusterfck of epic proportions

What does TDU have to say about this I wonder? They used that as a point of contention in 2013 to prove that the Teamsters had no intentions of striking even if it was the wishes of the membership.

From what I have gathered, it is 60 because it is a national contract and some state labor laws would be violated.

Thank you DanaCos for sharing this. I am floored that this administration had a year to plan it and we get this.

Fred Zuckerman would be the perfect person to ask. He posted all over Vote No Facebook page about them (Hoffa administration) not giving the proper notice. The only thing about that is he did the same thing back in 2001 with Jeff Boat.

Several JeffBoat workers refused to enter the shipyard and started an unsanctioned picket line. Other workers joined in and by lunchtime there was a total walkout at JeffBoat shipyard. That afternoon JeffBoat workers packed Local 89 demanding an answer from President Zuckerman who now claims a "clerical mistake" has resulted in a year-long extension of JeffBoat workers' contract.,
Ask Fred about his "clerical mistake".

Wasn’t it a clerical mistake claiming 206,000 new members? They then blamed and fired a 30 year employee. Actually they called a “ keystroke mistake” , so why should an employee be fired over a simple mistake?

Let's also not forget about the letters he wrote to Hoffa how proud he would be to be on his executive board after running against him. Fred was never out to reform the union.
