No Union worth its salt should ever allow an Employer, including giant UPS, to bargain directly with the unit members. If an employer can buy off the members of the employer’s choosing, the Union is disempowered.

Would UPS put the kind of money it offered out of the goodness of heart? Hell no. If the Employer wants to request to amend the contract by adding the kind of money they put on the table for members pursuant to the buyout offer, it should only be entertained by the Union if the benefits are shared across the board. And then, it must be subject to a secret ballot ratification in accordance with the Teamsters Constitution.

So thoughtful of UPS to throw a hand grenade into the party. They clearly knew what they were doing. AlJackson1962 is right, it is direct dealing and a ULP but what a dilemma, it's a popular and good economics for lots of Teamsters and everyone that takes it means one less laid off.

Maybe the answer for O'Brien is to fight as hard against the layoffs as he's fighting against the buyout. So far they haven't fought the layoffs at all.

Wiggy: The problem in fighting layoffs may be tied to any Management Rights provisions that allow UPS to layoff members. I'm not too familiar with the UPS contract and the history of how layoffs are permitted under the contract terms; most contracts I'm familiar with provide for layoffs due to lack of work. But, my understanding is the contract requires UPS to create new jobs. The most immediate issue I see that the Union should address, is being transparent and open with Union members. Did OZ drop the ball on demanding the contractual language to guarantee the creation of new jobs, without sacrificing other jobs? As I recall, O'Brien demanded a final offer from UPS even before the last contract expired (Why in hell would he do that?). O'Brien is more like Donald Trump every day. The "historic contract" characterization is right out of Trump's playbook. We need to dump Trump and OZ before we're all fucked.

It has been my strong expectation that SOB was aware of the fault with the language that he sold as "protection". I'd expected that he may even have felt as if it was the "best" that the Teamsters could have obtained. Where he was disingenuous (dishonest) was in the way that he just didn't clearly explain it, recommend it, and then allow the membership to decide their own path forward at that point. THAT IS HIS RESPONSIBILITY. When a statement is designed to have the effect of a lie...it is a lie. SOB is a sellout.

A few people have mentioned the need for transparency, there is none with SOB. I don't believe for a second that UPS agreed to create brand new positions even though they're in the process of downsizing the workforce. Let's see how that works out. SOB lies as much as Trump.

ibt's lm2's will be out soon. what people seem to forget is, what about all the companies that have dissolved? that serves as negative organizing, so when they announce they organized 90-100k is it really? like 4thfloor said, you have to be a dues paying member to be counted.
