    IBT Sues UPS

    The Teamsters Union filed an emergency motion for a temporary restraining order and preliminary injunction against United Parcel Service today, demanding the company shut down its plan to roll out a second illegal buyout scam targeting UPS Teamsters drivers. The package giant has told the union it aims to announce the Driver Choice Program (DCP) this week.

    Is this really what concerns the membership? Seanie files a meaningless suit as members go out the door with a little coin. If I was in the west I'd be pissed that he cut pension contributions to my fund while increasing them to HIS horribly managed New England States fund.

      It’s worth fighting the unilateral UPS retirement bonuses. But I would think it’s a clear NLRA direct-bargaining violation. Surprised that it’s being filed in court as a lawsuit.

        Barry 455: Who knows what their game plan is (IBT leadership). My understanding is the Union can start with a ULP charge and with it ask for a 10j injunction.
        If a speedy decision is being sought, what happened last Fall when UPS first rolled out this retirement incentive? What action did the Union take then? The Union needs to prove a history of confronting this ULP. May be its still within the six months to file a ULP charge retroactive to UPS first implementing this unilateral change last Fall. What information was requested by the Union then; how many members opted in then? Has this information been made available to Local unions and rank & file members? Whole lot of questions.

        I think maybe we lost the grievance and had to go to court? Wasn't this already litigated? ALJACK makes very good points. You can ULP strike over a failed response to written info request just like any other. And they're easier to win! Better than failure to negotiate a vol program...Come on Fred!!

        "$150,000 Regardless of years of service" Am I wrong or will there be a lot of newer drivers with only a few years in that will jump on this offer? The guys that aren't vested, and young enough that they are not worried about health care.

        A lot of people, with various years in are looking at this as a chance to leave. If you've got a year or so left why not go early?

      Maybe the street tough wee little Leprichaun should have worked the muscles between his ears in negotiations. An exodus by senior drivers benefits only the company who will benefit from the progression lower vacation benefits and a younger possibly healthier workforce. The pensions won't be so fortunate with higher withdrawls and a shrinking part time workforce. The tough guy got played, suing UPS will fail just as he did in negotiating language to protect our members. YOU GOT PUNKED SEAN. We all got punked voting for his dumbass.
