UPS is making plans to offer buyouts to its drivers for the first time ever, prompting staunch opposition from the Teamsters union.

Regardless of what O'Brien says it will be a stampede for the exits.

Why wouldn’t it be? If someone is eligible to retire and this is an incentive?

I'd like to know what the package looks like and who's eligible. For alot of people the other option is get laid off, UPS is cutting back, no more Amazon. O'Brien says its illegal, more BS.

Shouldn't that have been part of the historic NDA driven negotiations?

It's a violation of the NLRA; direct bargaining with employees represented by the Union, the members' exclusive bargaining agent.

Then Sean’s buddy Trump will back us up! No?

That will be an excellent question! O’Brien has been complaining about Democrats letting us down, let’s see if the republican labor people come through for us.

Unfortunately, in todays labor law, and the Trump NLRB, charges when issued and heard will be years and ultimately the Supreme court will rule 8-10 years from now.

So, Richard Hooker announces his bid for IBT General President and OZ finally notices UPS is violating the contract.

Nice job Richard Hooker, got OZ to do something in your first week!

Maybe the members will finally see that questioning O’Brien instead of fawning over him gets more results!

Jackson is right. But then again UPS will break the law and and it will be tied uo in court forever.

First of all the buyouts are not illegal. And many of the old timers ready to go will take the incentive to get out.

O'Brien can practice picket all he wants but this is just another battle he lost against Big Brown.

Does anyone remember when UPS began laying off the 22.3 jobs in 2008 as the subprime mortgage crisis unraveled? As TDU and the reformers put up a fight against the layoffs, O'Brien was part of the Hoffa machine to shut down the reform movement.

UPSers have not been at 340k like O'Brien likes to claim. By the end of the buyout the numbers will probably fall below 300k.

The employer must bargain over the effects. I expect that they eventually will. I expect that the current "offer" is a way of posturing for now.

Faust: Unless the CBA includes a waiver to effects bargaining (I'd be surprised if the UPS CBA has such a provision), the Employer can't bargain directly over terms and conditions of employment, including offering unit members a buy-out to give up their seniority, all while bypassing the Union in that process, correct?
But I also recognize that there are plenty of tools the Employer can use to stall a ULP complaint (that is - if the NLRB were to issue a complaint0, and who knows what the current NLRB will do if a ULP charge is filed by the Union.

Were the Market Rate Adjustments UPS gave part-timers illegal? If you are eligible to retire and UPS is offering an incentive to get out why would that be illegal?

I'm not familiar with "Market Rate Adjustments" that UPS gave part-timers, can you point me in the direction (dates, location, etc.)?
                  Thanks.

MRAs were used all over the country in cities where the minimum wage was way higher and cost of living required it especially during the pandemic. Part timers were paid above the contract rate to start (in addition to every current worker making less than the MRA).

For example, I was hired in 2021 for $26 an hour (they lowered it to $23 after 6-7 months). PTers made about $15 elsewhere, their contract rate. It was a huge issue OZ punted with this contract by red circling all PTers with MRAs, allowing us to get the $2.25 GWI on top of MRAs, effectively turning every seniority PTer into a yes voter.

Point being that UPS can always legally pay us more than the contract calls for, as long as everyone in that job class gets the raise. I think Faust's logic being that UPS can also legally offer money to people to retire or quit, as long as the offer is applied equally. I tend to agree that there is no way the IBT wins this in court or on the shop floor. They've proven they're not prepared for any fights big or small with UPS. All just more hot air from O'Brien & gang.

I don't remember SOB having a webinar calling the market rate adjustments/MRAs illegal
