    Chris Rosell the history of a union buster

    10 years ago IBT organizers led by John Palmer unionized and won representation. Chris Rosell flipped and union busted the organizers. Rosell thought he would be promoted. Fortunately he was not and Hoffa Jr. fired him. He went to go to work for 856 and his members requested to get a new local for representation or they would decertify because Rosell was not showing up. Peter Finn gave in and gave those members to to local 70.

    Was there never a first contract to begin with? Or did the organizers later decertify

      When he couldn't get his own way with the senior staff. He then stabbed his P.O. Steve Vairma in the back, and sucked up to O'Brien. That's how he got his position. He and his buddy from Texas conspired to get alot of folks fired.

      Statement on Chris Rosell from TDU royalty Diana Kilmury. She has had a movie made about her called Mother Trucker. She was also an IBT VP twice. Statement pasted below.

      As many of you are aware Int. VP, John Palmer was fired from his position with the IBT Organizing Dept. Clearly, he is at odds with the O'Brien administration.

      However, despite the outrageous and mean spirited letter by Organizing Dept. Director, Chris Rosell to Palmer's former employer, ABF attempting to nullify his seniority rights; I have trouble believing that Sean O'Brien or anyone familiar with the International Constitution would make such a statement as was alleged.

      It may be that there was a misunderstanding between being eligible to run for office and maintaining company seniority rights while employed by the International. In either case, Rosell is dead wrong.

      International Officers are paid a salary per the Constitution (Article V, Section 1(a) p.34), can't be fired because they're elected and can only be removed by being found guilty of charges preferred in accordance with Article XIX.

      Irrespective of whether International Officers have additional paid positions with the International, they satisfy the eligibility for office requirements of Article II, Section 4 of the International Constitution.

      International Constitution
      Art. II, Sec. 4 (pp. 16-17)

      (e). All officers and employees of the International Union and of any affiliate (excepting licensed, professional personnel employed as such) shall be considered as meeting the requirement of working at the craft within the jurisdiction for the purpose of retaining active membership and to be eligible for election to office in a Local Union in which he is a member or the International Union or any subordinate body or as a delegate to International Conventions.

      However, officers who are not full-time employees of an affiliate, who are not otherwise employed at the craft, and who do not receive a salary for performing work for the affiliate in addition to their duties under the Bylaws, shall not be considered to satisfy the working at the craft requirement by virtue of being an officer.

      Note: I'm not taking sides in this unfortunate and unsavory dispute, although I am disgusted with Rosell's actions, rather I am merely pointing out the applicable sections of the International Constitution that pertain.​
