The Teamsters won the Cemex decision to transform union organizing and to finally make employers that commit labor violations face real consequences. With the Cemex decision in place, companies can either recognize unions with majority-support or ask the NLRB to run an affiliation election. If companies refuse and violate labor law during the election, the NLRB now issues bargaining orders which order them to recognize the union and begin bargaining immediately.
When the NLRB ordered Cemex to bargain with the Teamsters last year, setting a precedent for the entire labor movement, it was a catalyst for workers at every employer in the country.
Because of the Cemex decision the Teamsters fought for, unionization petitions have skyrocketed nationwide, with a 2,000% surge in the number of employer-filed petitions. Unions like the Teamsters have won over 70% of employer-filed petitions.
